Upcoming Changes to the Vacation Rental Permitting Process in South Lake Tahoe

The El Dorado County Superior Court recently overturned Measure T, a voter-approved initiative that aimed to restrict vacation home rentals (VHRs) in residential areas. This ruling has prompted the City Council to propose amendments to the 2018 Vacation Home Rental Ordinance, which, if approved, will introduce several important changes to the permitting process.


Background: The Overturning of Measure T

Measure T was designed to impose restrictions on vacation rentals to address community concerns about noise, overcrowding, and the overall impact of short-term rentals on residential neighborhoods. However, the court's decision to overturn this measure has opened the door for new regulations to be developed. As the city moves forward, understanding the proposed changes is crucial for anyone involved in the vacation rental sector.


Recent Developments

On June 3, 2025, the City Council approved the first reading of an amended VHR Ordinance. A second reading and potential adoption of the ordinance is scheduled for the next City Council meeting on June 17, 2025. If the City Council votes to adopt the ordinance on this date, it will become effective on July 17, 2025.


Key Proposed Amendments to the VHR Ordinance


1. Location and Density Restrictions

The final motion has removed any caps on permits and established a 150-foot buffer between VHR properties. Attached condos that held a VHR permit as of September 1, 2016, will be exempt from this buffer requirement, allowing for greater flexibility in certain areas.


2. Operational Requirements

The proposed amendments also introduce stricter operational requirements for VHRs:

  • Check-In Procedures: The check-in process will now allow for either in-person or electronic face-to-face check-ins, requiring a wet or electronic signature within the first 24 hours of occupancy.

  • Monitoring: Properties will need to implement indoor noise monitoring and outdoor monitoring for trash and parking to maintain neighborhood standards.

  • Trash Management: VHRs will be required to use animal-resistant recycling carts to mitigate wildlife interactions.


3. Occupancy Limits

To promote responsible use of vacation rentals, the proposed changes include a reduction in the occupancy limit to two guests per bedroom, with an exemption for children aged five and under.


4. Defensible Space Inspection

In light of wildfire risks, a defensible space inspection will be required for all VHRs.


5. Increased Enforcement Measures

The city is looking to increase consequences for violations of VHR regulations. Owners can expect stricter enforcement, with rules applying uniformly across all properties.


6. Permit Issuance and Appeals

All VHR permits will now be issued by the police department, with a monthly cap of 150 permits. Notably, there will be no two-year waiting period for permits, allowing for more immediate opportunities for property owners. The Planning Commission will have the final say on appeals related to permit revocation or denial, particularly for cases involving multiple citations within a 24-month period.


7. Fee Review and Preferences

There will also be a review of the VHR permit fee structure to ensure complete cost recovery. Additionally, priority will be given to previous VHR and QVHR permit holders during the permitting process.


Important Considerations for Property Owners

It’s worth noting that these proposed changes will only apply to properties within the city limits of South Lake Tahoe. Many homes shown as being in South Lake Tahoe on platforms like Google Maps and Zillow may actually be located in unincorporated areas regulated by the county, which are not subject to these new regulations.
